Estate planning is not only for the wealthy; individuals of all income levels can benefit from thoughtful planning to ensure that their wishes are carried out and their loved ones are taken care of in the event of incapacity or death. Regular reviews and updates to the estate plan are essential to account for changes in personal circumstances, laws, and financial situations.
Estate and Trust administration can be a complex and time-consuming task, and the level of involvement required may vary based on the size of the estate and the specifics of the decedent's financial and family situation. Executors and administrators often seek the assistance of legal and financial professionals to ensure that the process is carried out correctly and in compliance with applicable laws.
During probate, the court appoints an executor (if there's a will) or an administrator (if there's no will) to manage the estate. The executor or administrator is responsible for inventorying the deceased person's assets, appraising their value, settling outstanding debts and taxes, and ultimately distributing the remaining assets to the beneficiaries. Probate can be a time-consuming and costly process, and it becomes a matter of public record.
